1. Acceptance of Terms
By accessing or using PackMyRide ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.
PackMyRide is operated in Brisbane, Queensland, Australia. These terms are governed by the laws of Queensland, Australia.
2. Service Description
PackMyRide is a peer-to-peer marketplace that connects bike bag owners ("Hosts") with people who need to rent bike travel bags ("Renters"). We act as an intermediary platform and do not own, control, or manage any of the bags listed on our service.
As a marketplace intermediary, PackMyRide:
- Facilitates connections between Hosts and Renters
- Processes payments securely through Stripe
- Provides a dispute resolution process
- Offers compatibility tools and bag ratings
3. User Accounts
To use PackMyRide, you must create an account with accurate information. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use our service.
Hosts may be required to complete identity verification before listing bags for rent.
4. Booking & Payments
Rental Fees
Hosts set their own rental prices. PackMyRide charges a 15% commission on each completed rental. Renters pay the full rental fee at the time of booking.
Deposits
A $500 AUD security deposit is held (not charged) on the Renter's card at booking. The deposit is automatically released 48 hours after successful return of the bag in its original condition. If damage occurs, the Host may file a claim against the deposit.
Payouts
Host payouts are processed via Stripe Connect within 2-3 business days after the rental period ends and the deposit hold period passes.
5. Cancellation Policy
Renter Cancellations
- More than 7 days before rental: Full refund
- 4-7 days before rental: 50% refund
- Less than 4 days before rental: No refund
Host Cancellations
- More than 7 days before rental: No penalty, Renter receives full refund
- Within 7 days: Renter receives full refund plus $100 credit
6. Damage Claims Process
Hosts must report damage within 48 hours of bag return with photographic evidence. PackMyRide will review claims and make a fair determination. If approved, funds will be released from the Renter's deposit to cover reasonable repair or replacement costs.
7. User Conduct
All users agree to:
- Provide accurate information in listings and communications
- Treat other users with respect
- Handle rented bags with care and return them in good condition
- Complete agreed-upon pickups and returns on time
- Not use the platform for fraudulent purposes
8. Liability Limitations
PackMyRide acts as an intermediary marketplace only. We do not guarantee the quality, safety, or legality of listed bags. We are not responsible for:
- The condition or performance of any bag
- Damage to your bike during transport
- Actions or omissions of other users
- Loss of belongings or equipment
To the maximum extent permitted by Australian Consumer Law, our liability is limited to the amount of fees paid to PackMyRide for the specific transaction in question.
9. Dispute Resolution
If a dispute arises between users, we encourage direct communication first. If unresolved, users may submit a dispute to PackMyRide. We will review the evidence and make a binding determination within 7 business days.
10. Termination
PackMyRide may suspend or terminate user accounts for violations of these terms, fraudulent activity, or other conduct we deem harmful to the platform or community. Users may close their accounts at any time through account settings.
11. Governing Law
These terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in the courts of Queensland.
12. Changes to Terms
We may update these terms from time to time. Continued use of the platform after changes constitutes acceptance of the new terms. We will notify users of significant changes via email.
